885 03 March 2010 New requirements for student applications under Tier 4 of the points-based system have come into effect today.
The new requirements are as follows:
We have raised the minimum level of English language course that Tier 4 (General) students can study, to level B2 of the Common European Framework of Reference for Languages (CEFR). Before you can apply to study an English language course in the UK, you will need to show that your English language skills are at CEFR level B1 or higher. (There are exceptions if you are a government-sponsored student or if you want to study a pre-sessional English course that meets certain requirements.)
If you are applying under Tier 4 (General) to study a course that is below degree level and is not a foundation degree, we have reduced the amount of work that you can do during term time to 10 hours per week. (The maximum level used to be 20 hours per week).
If you are applying under Tier 4 (Child) and you are 16 or 17 years old, we have reduced the amount of work that you can do during term time to 10 hours per week. (The maximum level used to be 20 hours per week).
If you are applying to study a course under Tier 4 (General) for six months or less, you will no longer be able to bring your family members (known as 'dependants').
If you are applying to study a course lower than degree level (excluding foundation degree courses) under Tier 4 (General), your dependants will no longer be able to work (unless they qualify to work in their own right under Tier 1 or Tier 2 of the points-based system).
If you have submitted and paid for your application before 3 March 2010, you will be considered against the rules that were in force at the time when you applied.
886 22 February 2010 We have today implemented the final phase of the points-based system's student tier. This has resulted in two major changes for Tier 4 sponsors.
You will need to provide all potential students with a CAS reference number and your sponsor licence number (SLN). You will also need to give them all the information they will need when making their application. The new measures for students include:
* a good standard of English (equivalent of holding just below a GCSE in a foreign language) will be needed to come to the UK and study to improve English language competency further;

* restricting the lowest-level courses (A levels and equivalent) to only the most trusted institutions;
* halving the amount of time a student studying below first degree level or on a foundation degree course will be able to work, to just 10 hours during term time;
* a ban on bringing in dependants for anyone studying a course for less than six months; and
* a ban on dependants of anyone studying a course lower than foundation or undergraduate degree level from working - they will face removal from the UK if found doing so.
* a ban on foreign students studying below degree level if the course includes a work placement - unless that course is being provided by a university, college or training provider which has the status of 'highly trusted sponsor';
* a requirement for students to demonstrate their English language ability by passing an approved secure test - this will apply to all students studying below (foundation) degree level, including those coming to study English language; and
* the introduction of tougher criteria for defining which course providers count as 'highly trusted sponsors' of foreign students. We expect that all publicly funded universities and colleges will count as highly trusted, and we will ensure that there is a rapid but rigorous system for ensuring that private training colleges can also gain that status as soon as possible.

The independent Migration Advisory Committee has completed its review of Tier 1 of the government's points-based system.
Earlier this year, the government asked the MAC to consider whether the criteria for Tier 1 should be changed in 2010/11 to reflect changing economic circumstances. The MAC's report, published today, says that Tier 1 is generally operating well, but also recommends some changes.
Regarding the Tier 1 (General) route for highly skilled workers, the MAC's recommendations include:
the salary multipliers, which are used to convert previous earnings outside the UK into a UK equivalent, should be rapidly and thoroughly reviewed;
migrants with a bachelor's degree but no master's degree should be allowed to come to the UK under Tier 1 (General), if their previous earnings are high enough;
professional qualifications (in law and accountancy, for example) should be considered as equal to a master's degree;
the pay thresholds should be substantially increased, with no points for previous annual earnings below £24,000;
migrants with previous annual earnings of at least £150,000 should not need to meet the educational qualification requirements;
applicants should receive points for their age if they are 39 or under; and
successful applicants should initially be allowed to come to the UK for two years, rather than three as at present, with a three-year extension later if they are in highly skilled employment.
The government will announce whether it accepts the recommendations in early 2010. The announcement will be published on this website.

895 25 September 2009: Student Tier 4 applications - maintenance funds must be in bank accounts for at least 28 days. From 1 October 2009, for all points-based system Tier 4 applications made outside the UK, the amounts required to meet the maintenance criteria must be held in your personal or your parent(s)/ legal guardian(s) bank account for a minimum period of 28 days prior to making your visa application. The end of the 28 day period must not be more than 1 month before the date of your application, for which you must show bank statements/other evidence. The transitional arrangements that were in place allowing funds to be held on the date of application only will no longer apply to applications made outside the UK, on or after 1 October 2009.
896 25 September 2009 The UK Border Agency has published information on how sponsors under the points-based system can renew their annual allocations of certificates of sponsorship and confirmations of acceptance for studies.
When an employer or education provider applies successfully for a licence to sponsor migrant workers and/or students under the points-based system, we allocate them a certain number of certificates of sponsorship and/or confirmations of acceptance for their first year as a sponsor.
At the end of that year, and every year while they are a sponsor, they must request a new allocation. Allocations cannot be carried over from one year to the next, and a sponsor cannot sponsor any more migrants if it has used its current allocation.

The UK Border Agency has agreed a concession for students who are non-EEA nationals to enter the United Kingdom for up to six months on an exchange or educational visit to a state-maintained school.

To be allowed to enter the United Kingdom as the husband, wife or civil partner of a PBS applicant, the dependant and the main applicant must both be aged 18 or over on the date when they are due to arrive in the United Kingdom.
901 19 August 2009 The UK Border Agency has made urgent provision for students with International Baccalaureate qualifications awarded on 5 July 2009, enabling them to apply to United Kingdom universities this year under Tier 4 of the points-based system. Where a sponsor has assessed a student on the basis of an International Baccalaureate award awarded on 5 July 2009, it must clearly explain in the student's confirmation of acceptance for studies/visa letter that it has confirmed the student's results using either the UCAS or International Baccalaureate Office online checking systems.
If the Tier 4 sponsor has already issued the student's confirmation of acceptance for studies/visa letter, it must provide the student with a separate letter explaining that it has confirmed the student's results using either the UCAS or International Baccalaureate Office online checking systems. The student must include this letter with their Tier 4 application. When a student applies for their Tier 4 visa, they will need to provide a printout of their results from the UCAS or International Baccalaureate Office online checking service.
